Amendment XXVIII:
Section 1.

The legislative powers of the Congress of the United States of America shall be restricted to those specifically enumerated in Article I Section 8 and further limited by Amendment X of this Constitution. Additionally, Congress shall not, by any action or inaction, allow any legislation which shall give more powers not so enumerated to, or remove any powers so enumerated from, themselves, the Executive Branch (as indicated in Section 2 of this Amendment) or the Judicial Branch (as indicated in Section 3 of this Amendment), unless so called for and approved by the amendment process allowed for in this Constitution.

Section 2.

Likewise, the powers of the Executive Branch of the United States of America shall be restricted to those specifically enumerated in Article II of this Constitution. The Executive Branch shall in no way, by either action or inaction, allow or cause the Legislative Branch or the Judicial Branch to violate the strictures set forth by Section 1 or Section 3, respectively, of this Amendment.

Section 3.

Furthermore, the powers of the Judicial Branch of the United States of America shall be restricted to those specifically enumerated in Article III of this Constitution. The Judicial Branch shall in no way, by either action or inaction, allow or cause the Legislative Branch or the Executive Branch to violate the strictures set forth by Section 1 or Section 2, respectively, of this Amendment.

Section 4.

Additionally, it is hereby stated that the power of Congress “to regulate commerce”, as enumerated in Article I Section 8 of this Constitution, shall be defined by its original meaning of “to make regular the commerce” and that such power does not extend to the control, taxation or prohibition of said commerce by either federal, state or local governmental agencies.
